The ICO code : put that camera away, my face is private

Not content with abrogating photographers' copyright, another part of Government is now going some way to ban photography altogether in public places, for data protection reasons. The Information Commissioner's Office (ICO) proposed new code for personal information online has "commonsense" new rules that in effect will prohibit photography in public places where anyone who's in the photograph might be unhappy about being photographed. A photo, taken in public, is now deemed private data, y'see.

So to put it plan and simple... you have to ask everyone in the picture if they want the picture taken. F*ing stupid if you ask me. I guess we will have to announce that video and photographs will be taken during OggCamp and these will be put online. Anyone not wishing to be photographed is requested to leave!

It's NOT a law. Merely a proposal to change the law.
Besides, legal precedent has already been established by a similar lawsuit (can't remember the state) where the court decided that personal privacy is NOT violated IF:
1) The photographer is in a public place.
2) The person (whose privacy is in question) in the photo is also in a public place.

Essentially, once you leave the privacy of your home/car/etc, you give up your rights to privacy. Also, the photographer should not make attempts to conceal his activities [ie, hiding himself (peeping Tom) or concealing the camera (upskirts)]
The paparazzi use these terms in their own defense constantly.

Besides, you've always typically had to sign a consent form for commercial-use of your photos before. And this article is mainly focused on Trademark/Copyright protection, not personal privacy.

Not to mention, even if they did pass such a law, how would it ever be enforced?

Well, I mean, could they ever enforce it? It is not like you can arrest every guy or gal that are carrying around a camera/cellphone or pc that they can use to take photographs, that would be impossible.
